US Attorney Brendan V. Johnson announced that Geraldine Marie Whirlwind Soldier, a/k/a Marie Whirlwind Soldier, age 58, of Rosebud; Harvey Covey, age 59, of St. Francis; and Timothy Flammond, age 29, of Winner, were indicted by a federal grand jury on November 8, 2011, for Conspiracy to Distribute and Possess with Intent to Distribute a Controlled Substance and Possession with Intent to Distribute a Controlled Substance.
Defendants appeared before US Magistrate Judge Mark A. Moreno on November 17, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years of imprisonment, a $500,000 fine, or both. The charges are merely accusations, and defendants are presumed innocent until and unless proven guilty.
The investigation is being conducted by Rosebud Sioux Tribe Law Enforcement Services and the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant US Attorney Jay Miller is prosecuting the case. Whirlwind Soldier was released to a third party custodian, while Covey and Flammond were detained pending a detention hearing. A trial date has not yet been set.
